Terms of Service

1. Agreement to terms
These Terms of Service ("Terms") are a legal agreement between you and Traddie governing your access to and use of the Traddie mobile application(s), website, and related services (the "Service"). By downloading, accessing, or using the Service, you agree to be bound by these Terms.
If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms. If you do not agree to these Terms, you may not access or use the Service.
Throughout these Terms, "we", "us", and "our" refer to Traddie. "You" and "your" refer to you, the user.
2. Description of the service
Traddie provides a business management platform for UK tradespeople, including tools for creating quotes, managing jobs, sending invoices, collecting payments, tracking expenses, and syncing with accounting software. The Service is available via our iOS app, web app, and associated websites. We may add, change, or discontinue features from time to time. We will use reasonable efforts to notify you of material changes.
3. Account registration and responsibility
To use the Service, you must create an account and provide accurate, current, and complete information. You agree to:
- Maintain and update your account information as needed
- Keep your password and account credentials secure and confidential
- Accept responsibility for all activity that occurs under your account
- Notify us immediately of any unauthorised use or security breach
You must be at least 18 years old and capable of forming a binding contract to use the Service.
4. Subscriptions, billing, and free trial
Traddie offers paid subscription plans (e.g. Pro, Team, Enterprise) and may offer a free trial before billing begins. By subscribing to a paid plan, you agree to pay all applicable fees in accordance with the plan you select.
- Billing: Subscriptions are billed in advance (e.g. monthly or annually). Fees are in GBP unless otherwise stated.
- Free trial: We may offer a free trial period (e.g. 14 days). No payment is required to start a trial. At the end of the trial, you will be charged unless you cancel before the trial ends.
- Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will continue to have access until that date.
- Price changes: We may change subscription fees. We will give you at least 30 days' notice before any increase applies to your next billing period. Your continued use after the change constitutes acceptance.
- No refunds: We do not provide refunds for partial billing periods or unused time, except where required by law or at our sole discretion.
5. Apple App Store terms
If you downloaded the Traddie app from the Apple App Store:
- These Terms are between you and Traddie only, not Apple Inc. ("Apple"). Apple has no obligation to provide maintenance, support, or any warranty for the app.
- Apple is not responsible for the app or its content. Any claims relating to the app are directed to Traddie, not Apple.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce them against you as a third-party beneficiary.
- To the extent that these Terms conflict with the Apple Media Services Terms and Conditions, the Apple terms will govern with respect to your use of the App Store and the app licence granted through it. These Terms apply to your use of the Service itself.
- Purchases and subscriptions made through the App Store may be subject to Apple's payment and subscription terms. Refund requests for purchases made through the App Store should be directed to Apple in accordance with Apple's refund policy.
6. Acceptable use
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party rights
- Infringe any intellectual property, privacy, or other rights of others
- Transmit harmful, offensive, fraudulent, or illegal content
- Attempt to gain unauthorised access to the Service, other accounts, or our systems
- Interfere with or disrupt the integrity or performance of the Service
- Use the Service for any purpose that is illegal or not permitted by these Terms
We may suspend or terminate your account if we reasonably believe you have violated these Terms or engaged in conduct harmful to the Service or other users.
7. Intellectual property and licence
The Service and all content, features, and functionality (including software, design, text, graphics, and trademarks) are owned by Traddie or our licensors and are protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your internal business purposes in accordance with these Terms.
You retain ownership of the data you input into the Service (e.g. customer details, invoices). By using the Service, you grant us a licence to use, store, process, and display that data solely to provide, operate, and improve the Service and as described in our Privacy Policy.
You may not copy, modify, distribute, sell, or create derivative works from the Service or our intellectual property except as expressly permitted by these Terms or with our prior written consent.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, TRADDIE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure. You use the Service at your own risk. We are not responsible for the accuracy of data you enter or for decisions you make based on the Service. You remain responsible for your own tax, legal, and regulatory compliance.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRADDIE (AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED POUNDS STERLING (£100).
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited by law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Traddie and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to (a) your use of the Service, (b) your violation of these Terms or any law, or (c) your violation of any third-party rights. We reserve the right to assume the exclusive defence and control of any matter subject to indemnification by you, at your expense.
11. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your account and access to the Service immediately, without prior notice, if we believe you have breached these Terms, engaged in conduct harmful to the Service or other users, or for any other reason at our sole discretion.
Upon termination, your right to use the Service ceases. We may retain your data for a limited period as described in our Privacy Policy (e.g. for legal compliance). You may request export or deletion of your data by contacting us at hello@gettraddie.com.
12. Changes to the terms
We may modify these Terms at any time. We will post the updated Terms on this page and update the "Last updated" date. For material changes, we will provide additional notice (e.g. by email or in-app notification) where reasonable. Your continued use of the Service after the effective date of the changes constitutes your acceptance of the revised Terms. If you do not agree, you must stop using the Service and may close your account.
13. General
- Entire agreement: These Terms (together with our Privacy Policy and any other policies we reference) constitute the entire agreement between you and Traddie regarding the Service.
- Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect.
- Waiver: Our failure to enforce any right or provision is not a waiver of that right or provision.
- Assignment: You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
14. Governing law and disputes
These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer, you may also have rights under the laws of your country of residence.
